The Publisher

Mr A. Lal is Director General of Red Flower Publications Private Limited. It regulates all business at the executive level, including employee recruitment, dismissal, compensation, and important decisions for the company. All employees, staff, etc. work under his supervision.

The Managing Editorial Team

This group is responsible for all editorial work, including special sections such as art, editorial and production. However, all these areas are divided into two main categories:

  • Editor-in-Chief
    This is the position of the editor and is considered to be the head of the editing team. He is responsible for controlling the main content of the production and plays an essential role in budgetary decisions and contributes to hiring other editors.
  • Editors Department
    The second line of the editorial team after the Editor-in-Chief is the editors. It is part of the editorial management team responsible for manuscripts and other publishing documents, and for the editing and copyediting of manuscripts and other publishing documents and providing an alternative for the authors. Editors play an important role in finalizing books and articles in journals.

Art Department

The management team's art department focuses on the design of the cover of the book, both inside and outside. They design, but the sales and marketing departments approve the covers. The head of the editorial department is responsible for designing.

Production Department

This class is responsible for the physical production of books and journal issues, which includes the physical materials that make up the books and journals. Physical entities such as book binding methods and journal issue binding methods, paper stock, cut size, page signatures, number of pages, etc. It plays an essential role, as the cost of producing books and journals will have a huge impact on the editor's statements of profits and losses.

The Proof-reader

Proof-readers are the next in the publisher hierarchy and are responsible for proofreading. He is responsible for assessing grammatical errors, including improving the syntax of sentences, determiners, vocabulary, clarity, spelling errors. This is a complete job that requires time.

The Literary Agent

This is an employee responsible for supporting the publication of literature and overseeing the payment process of books and journals to the author. Their work as agents is to follow-up and pursue contracts with unpublished authors. Many literary agents work in publishing companies in a variety of literary genres. These agents are classified by the type of books and journals they work with.

The Creative Experts

This is a team of individuals who specialize in all artistic designs and drawings needed.

The Marketing Team

This group is responsible for implementing the appropriate marketing strategies of the publisher. Their work includes creating promotional and advertising campaigns.

The Financers

Last but not least, the people responsible for the financial aspects of the publishers are accountants and financial experts.

The Red Flower Publication Private Limited was founded in New Delhi by Mr. A. Lal, a 36-year-old Meerut University post-graduated and Library and Information Sciences post –graduated from IGNOU (New Delhi) who had previously held a publishing -related job at India’s prestigious medical institution “All India Institute of Medical Sciences, New Delhi. After leaving the job from AIIMS, New Delhi in February, 2000 he started a library supply agency and after serving hundreds of libraries including universities in India and abroad he started a India’s number 1 peer-reviewed journal “Indian Journal of Library and Information Science” in 2007.

In 2008, he started 6 medical super speciality journals. In 2009 he formed a publishing company “Red Flower Publication Private Limited” and immediate its formation the company started 4 more peer reviewed journals. The company by the supervision of Mr.Lal currently publishing 61 medical and scientific journals which are circulated worldwide. The Red Flower Publication Private Limited published relatively few books per year and issued only titles in which the firm's owner himself believed.

New ad copy and creative for pharmaceutical products should be sent to the advertising department. Please allow two weeks for clearance.

  • Advertisers should make available to Red Flower Publication the marketing authorization and summary of product characteristics when submitting their advertisement. In the case of drug advertisements, the full generic name of each active ingredient should appear. Each page of an advertisement for a prescription-only medicine should be clearly labeled as intended for health professionals.
  • If any advert is requested outside of Red Flower Publication standard advertising positions then a request should be made to editorial who will respond with a full and final decision within two business days.

Ads that discriminate against applicants based on sex, age, race, religion, marital status or physical handicap will not be accepted. Advertiser may cancel the entire Insertion Order, or any portion thereof, as follows:

  • On written notice to Publisher given 21 or more days before the start date. With cancellations inside 21 days of the start date, advertiser will be responsible for 50% of the IO amount that was reserved for delivery.

Advertisement Standard Code of India (ASCI)
The Advertisement Standard Code of India investigates complaints about published medicines advertisements and ensures compliance with the India Codes of Advertising and Sales Promotion which include a section on medicines advertising. It also monitors advertising in the press, direct marketing and sales promotion and on the Internet. Advertisements directed at health professionals are exempt from the India Codes of Advertising and Sales Promotion.

The Prescription Medicines Code of Practice Authority (PMCPA)
Complaints about the advertising of medicines supplied on prescription are considered by the Prescription Medicines Code of Practice Authority under the OPPI Code of Pharmaceutical Practices. Complaints which are made under the Code about promotional activities and promotional material are considered by the Code of Practice Panel, the decisions of which can be appealed to the Code of Practice Appeal Board. Reports on completed cases are published quarterly in the Code of Practice Review.

ASCI: India's Advertising Regulatory Framework

Advertising, generally speaking, is the promotion of goods, services and ideas, usually performed by an identified sponsor. Marketers see advertising as part of an overall promotional strategy. Other components of the promotional mix include publicity, public relations, personal selling, and sales promotion.

The Advertising Standards Council of India (ASCI), established in 1985, a body committed to the cause of Self-Regulation in Advertising, ensuring the protection of the interests of consumers to maintain and enhance the public's confidence in Advertising.

This write up attempts to explicate the initiative taken by ASCI in controlling and promoting the concept of fair advertising practices in India and its impact on the advertisements prevailing in the Pharmaceutical Sector at present.

In regards to promote fair practices of advertisement in the Indian market and protect the right of customers as guaranteed under the Consumer Protection Act, 1986, ASCI had come up with the regulatory mechanism termed as "Code for Self-Regulation in Advertising"["Code"] with the prime objectives to identify and control the content of advertisements so that they are not offensive and illegal in nature and should not intent to misrepresent the customers so as to achieve fair advertising practices in the scenario of Indian market by ensuring the following basic guidelines:-

To ensure the truthfulness and honesty of representations and claims made by advertisements and to safeguards against misleading advertisement.

To ensure that advertisements are not offensive to generally accepted standards of public decency.
To safeguard against the indiscriminate use of advertising for the promotion of products which are regarded as hazardous to society or to individuals to a degree or of a type this is unacceptable to society at large.

To ensure that advertisements observe fairness in competition so that the consumer's need to be informed on choices in the market-place and the canons of generally accepted competitive behaviour in business is both served.

The code brings into its purview all those advertisers, advertising agencies, media or such other individuals who commission, create, place or publish any advertisement or assist in the creation or publishing of any advertisement which is in contravention of this Code and applies to advertisements read, heard or viewed in India even if they originate or are published abroad so long as they are directed to consumers in India or are exposed to significant number of consumers in India.

The Code is divided into IV chapters and the onset of it defines "advertisement", "product", "consumer", "advertiser", "advertising agency", "media", etc. The Code not only includes all form of paid- for communication, addressed to the Public or a section of it but does not exempt even those form of communication which is carried free-of-charge for any reason in the normal course which is recognized as an advertisement by the general public. Hence, advertisers or advertising agency or media or any such related person cannot defend himself/itself from the purview of the Code on the ground that he/it was not indulged in a communication for commercial promotion of any product and the communication was meant only for general reference.

ASCI and its reach on Pharmaceutical/ Allied health care Industry

Recently ASCI upheld approximately 36 complains in the category of Pharmaceuticals companies and Healthcare sector held for violation of the Code.

In an advertisement of the pain relief ointment Volini, Ranbaxy Laboratories Ltd. claimed as "99% doctors have used Volini to relieve their pain" and "Volini No.1 doctors' prescribed pain reliever since last 12 years".

Dabur India Ltd's Dabur Chyawanprash print ad claimed that "Dabur Chyawanprash provides 3 times more immunity", "Helps improve the ability to fight illness by 3 times", "ONLY Dabur Chyawanprash provides immunity.

In the above matters, the advertiser was not able to substantiate the claim with necessary support and data and the ad were considered as contravention of the Code.

The National Advertising Monitoring Service (NAMS)

In order to maintain a track on misleading advertisements which harm the interests of consumers, ASCI announced an initiatives of a mechanism called National Advertising Monitoring Service (NAMS) which will work in partnership with TAM Media Research and will identify advertisements which are in potential violation of Chapter 1 of ASCI Code and will monitor ads in the sectors covering Auto, Banking, Financial Services & Insurance, FMCG (including F&B), Consumer Durables, Educational Institutions, Health Care Products & Services, Telecom and Real Estate sectors. The scope of work will cover the tracking of more than 30 newspapers (all editions) which contribute to over 80 per cent of national newspaper readership and all TV channels in all Indian languages. The mechanism will work on three-fold steps initiating from tracking advertisements that is seen as being potentially violating Chapter 1 of ASCI Code which will then be forwarded to ASCI on a weekly basis, post which ASCI would process them according to its normal complaint procedure involving its Consumer Complaints Council (CCC) for adjudication.

Keeping in view the initiatives undertaken by ASCI in the recent past and irrespective of the fact that the Code introduced by ASCI is voluntary in nature, the advertisers ought to give regard to such Code at the time of publishing their advertisements since if any advertiser fails to comply with the CCC decision in writing on a complaint upheld against a Press Ad, the ASCI has option to inform the Press Council of India and Ministry of Information & Broadcasting about the print Ad contravening the ASCI Code and such action may dent the reputation of the concerned advertiser.
