Purpose: This study examines the evolving landscape of medicolegal practice in India, focusing on its incidence, legal frameworks, challenges, and recommendations for improvement. Methods: A review of legal statutes, case laws, and secondary data from academic journals and government reports was conducted. Key metrics included litigation trends under acts such as the Consumer Protection Act (2019), PC-PNDT, MTP, and Transplantation of Human Organs Act (THOTA). Key Findings: Medicolegal cases in India have surged post-1995, with medical negligence constituting 40% of litigation. The Consumer Protection Act (2019) intensified accountability, while interdisciplinary collaboration among medicolegal consultants improved case outcomes. Conclusion: Strengthening ethical standards, standardized medical documentation, and continuous professional education are critical to enhancing medicolegal practice quality.

Background: Legal medicine, or medical jurisprudence, integrates medicine and law, addressing forensic investigations, malpractice evaluations, and health-related legal issues. Globally, it encompasses subfields like forensic pathology, toxicology, and medical ethics. Technological advancements, including DNA profiling and digital forensics, have expanded its scope. In India, the field blends traditional practices with modern innovations, yet challenges like inadequate infrastructure and limited region-specific research persist. Aim: To analyze emerging trends in global legal medicine, with a special focus on Indian research output from 2000 to 2023. Objectives 1. Assess publication trends and thematic focus in Indian legal medicine research. 2. Identify leading institutions and their contributions. 3. Evaluate citation impact to understand research influence. 4. Explore gaps and potential future directions. Methods: A bibliometric study using data from the Web of Science Core Collection (2000–2023). The dataset was analyzed using VOSviewer and Biblioshiny for trends in publications, author networks, and thematic focus. Results: Indian legal medicine research saw a consistent rise post-2013, with dominant themes in forensic techniques (35%), medico-legal practices (25%), and emerging technologies (15%). Highly cited works centered on forensic toxicology and medico-legal ethics. The research corpus achieved an h-index of 30, highlighting moderate global impact. Conclusion: While advancements in forensic techniques and emerging technologies are notable, gaps in region-specific research and global collaborations remain. Addressing these challenges can enhance the field’s impact.

While medical professionals focus on bedside medicine, judicial offcers are tasked with applying the law. The distinctionbetween these two concepts is essential to ensure that both professions operate within their respective jurisdictions without overstepping boundaries. Aim: To define, differentiate, and elaborate on the concepts of “laws-in-medicine”and “laws-as-medicine” and to explore their implications in the context of medical negligence cases. Objectives: •To clarify the definitions and differences between “laws-in-medicine” and “awsas-medicine.” • To examine the role of judges in medical negligence cases and whether they overstep their jurisdiction by making medical judgments. • To discuss the implications of judicial immunity and statutory immunity for medical professionals. • To explore the mechanisms for addressing judicial overreach and ensuring equitable application of the law. Material: The analysis is based on a detailed discussion of the concepts of “lawsin-medicine” and “laws-as-medicine,” supported by examples from medical negligence cases. The discussion also considers the legal frameworks governing medical practice, such as the Indian Medical Council Act, the Indian Penal Code, and the Code of Criminal Procedure. Result: 1. Laws-in-Medicine refers to legal principles governing medical practice, including medical jurisprudence, ethical conduct, and professional responsibilities. 2. Laws-as-Medicine views legal principles as tools for promoting public health and well-being, emphasizing preventive measures. 3. Judges should focus on determining whether medical practitioners adhered to legal and ethical standards, rather than prescribing specific medical treatments. 4. Judicial immunity protects judges from personal liability for their decisions, but overreach into medical judgment may undermine statutory immunity for medical professionals. 5. The appellate process is the primary mechanism for correcting judicial errors, rather than prosecuting judges for incorrect decisions. Conclusion: The distinction between “laws-in-medicine” and “laws-as-medicine” is vital in maintaining the integrity of both the legal and medical professions. The lawmakers must respect the boundaries of their expertise and rely on medical experts to provide context in medical negligence cases. Analysing recent policies, digital health integration, and regulatory frameworks reveals systemic gaps, including health worker safety risks and skewed resource allocation. To achieve universal health coverage, reforms must prioritize increased public spending, preventive care, and scalable digital solutions. Strengthening regulations, fostering stakeholder collaboration, and equitable resource distribution are critical to mitigating disparities and litigation vulnerabilities. A patient-centric approach, coupled with investments in preventive and telehealth initiatives, is essential to build an inclusive, resilient healthcare ecosystem that addresses India’s evolving demographic and disease burdens.

This paper explores its definition under Indian law, particularly the Indian Penal Code (IPC), the General Clauses Act, and the Bharatiya Nyaya Sanhita (BNS) of 2023, while examining judicial interpretations and case law. Despite legal provisions protecting actions performed in good faith, challenges persist due to ambiguity, evolving legal frameworks, and public perception. This article discusses these issues, proposes clearer guidelines, and emphasizes balancing accountability and protection for healthcare providers. Through an analysis of statutory provisions, case law, and medical jurisprudence, the paper offers recommendations to enhance the implementation of good faith protections in medical practice.
