Assisted reproductive technologies (ART) occupy a unique intersection of medicine, ethics and law. In recent years, India has witnessed rapid advances in ART techniques alongside major legislative and regulatory reforms intended to safeguard the rights and welfare of patients, donors, surrogates and children born through these methods. Clinicians, medico-legal professionals, hospital administrators and policy makers therefore require an accessible, practical and authoritative guide that translates clinical practice into compliant, ethically sound and legally defensible operations.
This book, Medicolegal Updates on the Assisted Reproductive Technology Act: Indian Perspective — is an effort by three faculties of All India Institute of Medical Sciences, Patna to meet that need. Drawing on expertise from Forensic Medicine, Obstetrics & Gynaecology and Clinical Physiology, we have aimed to present a multidisciplinary treatment that combinesfoundational clinical science and ART techniques; a clear exposition of the statutory and regulatory framework in India; an operational guidance for ART clinics and banks (licensing, infrastructure, personnel, consent and record-keeping); medico-legal and forensic perspectives on disputes, parentage, and criminal offences; and practical tools — checklists, sample forms, flowcharts and case summaries — that practitioners can adapt for routine use.
The Units are arranged to help diverse readers: those less familiar with ART begin with basic reproductive physiology and ART techniques; clinicians and administrators can proceed to units on clinic setup, consent, documentation and compliance; legal and forensic practitioners will find detailed discussion of the ART Act, surrogacy interface, case law and investigative/forensic approaches; and policy-makers and academics will find commentary on gaps, ethical tensions and reform proposals.
While we have striven for accuracy and practical relevance, laws, rules and judicial interpretations evolve. Readers should treat the legal commentary as an informed guide and seek current statutory texts, notifications and expert legal advice when making decisions in specific cases. We welcome corrections, suggestions and updates from readers which will help us refine future editions.
We hope this volume will serve as a useful reference for clinicians, medico-legal experts, regulators, trainees and all stakeholders engaged in the responsible practice of assisted reproduction in India. Prof. Dr. Binay Kumar, MBBS, MD is currently working as Professor in the Department of Forensic Medicine and Toxicology, All India Institute of Medical Sciences, Patna. He has published/ presented 51 papers. Published 3 books/ book chapters. He has vivid experience of working in different fields of Forensic Medicine like Medico-legal Consultant of Bihar of Human Right Commission, Chairperson of Standing Medical Board of AIIMS Patna, Visiting Faculty of Bihar Police Academy. He has also experience of variety of medico-legal works, like Psychological autopsy, Narco-analysis etc.
Delivered various lectures on Medical Laws and ethics at various forums.
Dr. Indira Prasad, MBBS (LHMC), MS (LHMC), DNB (Obstetrics & Gynaecology), FICOG, FICMCH, MNAMS, is currently working as Additional Professor in the Department of Obstetrics & Gynaecology at AIIMS Patna. A trained endoscopist (Dip. in Gynae Endoscopy, Kiel School, Germany) with a Fellowship in IVF & ART (NCR), she has previously served as Assistant Professor at AIIMS Delhi and LHMC, and as IVF In-charge at Matritava IVF and Radix IVF, Delhi. Dr. Prasad has authored over 50 scientific publications and carries more than 14 years of UG/PG teaching experience. Her clinical and research interests include IVF and reproductive medicine, minimally invasive gynaecological surgery, high-risk pregnancy care and medicolegal aspects of obstetrics & gynaecology. She is an active member of national scientific bodies (FOGSI, AOGD, NARCHI, POGS, IAGE, AMASI, ISAR, IFS) and currently serves as Co-chairperson of the Medicolegal Committee, POGS (2024–25). A decorated clinician, she is a recipient of multiple honours including gold medals in MBBS and MS, the FOGSI Young Turk Award, FOGSI Travelling Fellowship, and recent recognitions such as the “Dr Vidya Bhasin Award,2026”,''Doctor Samman Award 2023'' and ''Pride of Bihar Award 2022.'’
Dr. Tribhuwan Kumar is Professor and Head of the Department of Physiology at AIIMS Patna. With over 20 years of academic experience, he has been actively engaged in teaching, research, and mentoring postgraduate students. His areas of interest include male infertility and lifestyle medicine. He has authored several publications in national and international journals. One of his research works on male infertility received the Asian Journal of Andrology (AJA) Outstanding Paper Award in 2024. He is also a recipient of the APPI Award of Excellence in Clinical Physiology (2025). This book reflects his academic expertise and sustained interest in the subject.
